3. OBLIGATIONS OF PURCHASER/SELLER:
PURCHASER agrees that all responsibility for keeping this Doberman in good health and keeping all inoculations up to date, worming regularly and sexual alteration (where necessary and agree upon) are his. The PURCHASER is responsible for forwarding the AKC litter registration application to register said dog within a reasonable period of time before expiration. In purchasing said dog as pet quality, puppies are sold with a limited registration and must be spayed or neutered at TWO years of age by the new owner. We recommend bitches to be spayed at TWO years of age due to urinary incontenence if spayed at a young age. Puppies born from these dogs on limited registration are unable to be registered with the AKC.
PURCHASER agrees that, if for any reason, he/she is unable to keep this Doberman, due to changes in circumstances, sickness, incompatibility or for any other reason, this Doberman will be promptly returned to SELLER for attempted placement in a new home. Selling to a third party is only permissible after prior consulation with the SELLER, whereby the main consideration is the assurance that the dog is passed to responsible owners. A puppy that is returned that is 4 months old to 7 months old, the buy back amount for said puppy from PURCHASER will be $300.00, ONLY if said dog is found healthy within 14 days of surrender. A puppy that is returned that is 7 months or older, the buy back amount for said puppy from PURCHASER will be $200.00, ONLY if said dog is found healthy within 14 days of surrender. The buy back price for a puppy with ears not standing and no basic knowledge of commands and is wild is $100.00. Within the 14 days that the said dog is returned or surrendered, any and all veterinary fees due to sickness that are incurred in that time frame will be the responsibility of the PURCHASER and must be paid to the SELLER in full to cover the veterinary bill. Each return of a animal has a different circumstance therefore, a refund check will be mailed 14 days after surrender OR when SELLER has placed animal in a new home, this is at the discretion of the SELLER. The AKC registration papers will accompany said puppy at time of return. SELLER retains right to repurchase the animal. SELLER has the right of first refusal. If we do not wish to buy the dog/bitch back from you we will give you our first refusal in writing at which time you are free to sell the dog to whomever you wish. Any one not offering SELLER the first buy back on a puppy we have sold will be held accountable to breech fee of $1,000.00. Contract is null and void if the ears are cropped and not standing, the dog is found to have been mistreated, AKC papers are not returned or have expired, vaccinations schedule was not maintained and proof of all vaccinations must accompany any requests for refund money, replacement puppies or surrenders. No replacement or money refunds will be given if the male or female has been bred or registration application form has expired. PURCHASER agrees that if SELLER finds dog unhealthy, crippled or with unsound temperament, 14 days from date said dog was returned, no moneys will be returned. It is further agreed that SELLER has complete and total control over placement of this Doberman. The cost of transportation of any pups to and from Braveheart Kennels and the cost of all veterinary services shall be the responsibility of the PURCHASER. Seller never wants to see her dogs in a SPCA or RESCUE situation.
Indemnity: PURCHASER shall hold SELLER harmless from all damages arising out of any damage to any person or property in the event that some person should become injured as the result of this animal. The PURCHASER shall also be liable for the death of this animal or injury rendering it incapable of reproduction if said death or injury is due to the negligence of the PURCHASER. Should any conflict arise between parties, SELLER is not responsible for any travel fees, attorney fees, or any legal fees whatsoever.
If your puppy dies or is crippled by distemper, hepatitis, leptospirosis, or parvovirus within 12 months of birth, the PURCHASER must prove that all shot schedules you were given at purchase time was followed and completed. You must either send proof that you have neutered or humanely destroyed your pup.
PURCHASER agrees that this Doberman will be treated as an integral part of his family, will not be kept tied, chained or otherwise abused. The Doberman will not be shut away from family members and isolated from full socialization with its family. Further, this Doberman will not be housed in a damp, cold, unheated environment. This Doberman will not be beaten, starved, neglected, and/ or abused in any respect. PURCHASER will write to or call the SELLER periodically for the purpose of reporting on mental and physical development of this Doberman, as well as its accomplishments.
I highly advise and recommend that any Puppy, purchased from me be tested for health problems at approximately one year of age and there after. Early detection can many times, lengthen the life of a dog with early treatment. I nor no one person can guarantee that a dog I sell or any person sells, will not come down with some disease. But I will do all in my power to strive for Longevity and Health in my lines, and I will make all buyers from me aware of health in my dogs.
I, Also Request that ALL Puppy Buyers from me, contact me and send me information of any health problems, with said dog so I can keep accurate health files on my lines! Pictures PLEASE!!!!

Failure of the NEW OWNER/PURCHASER to live up to any of the terms of this agreement will entitle the SELLER to reclaim the Doberman and its registration papers and to not be further obligated to the PURCHASER in any way, whatsoever, including but not limited to no obligation to refund any previously paid money.
The agreement shall be governed by the laws of the State in which SELLER resides, to the exclusion of any forum and constitutes the entire agreement between parties.

4. By signing this agreement/contract, we affirm that we have read, understood and agree to abide to the terms of this contract to set forth for our benefit and the advancement and protection of this Doberman detailed herein.
THIS THREE (3) PAGE CONTRACT OF SALE HAS BEEN READ BY BOTH THE UNDERSIGNED BUYER AND SELLER AND THEIR SIGNATURES AFFIXED HEREUNDER SHALL ATTEST TO THEIR COMPLETE AGREEMENT AND UNDERSTANDING OF THE CONTENTS OFFERED HEREIN. THERE ARE NO VERBAL PROMISES OF COMMITMENTS OFFERED TO BUYER ON THIS DOG. ONLY BOTH PARTIES SHALL HONOR THOSE GUARANTEES LISTED HEREIN. THIS SHALL BE DEEMED A LEGAL AND BINDING CONTRACT AND THEREFORE FAILURE TO LIVE UP TO ITS TERMS CAN MEAN LEGAL RAMIFICATIONS, WITH THE PARTY AT FAULT BEING RESPONSIBLE FOR ANY LEGAL FEES INCURRED BY THE OPPOSING PARTY. SHOULD ANY CONFLICT ARISE BETWEEN PARTIES, SELLER IS NOT RESPONSIBLE FOR ANY TRAVEL FEES, ATTORNEY FEES, OR ANY OTHER LEGAL FEES WHATSOEVER. IF BUYER IS FOUND TO BE IN VIOLATION OF THIS CONTRACT AND DOG IS LEGALLY REDEEMED BY SELLER, BUYER AGREES TO SIGN OVER TO SELLER THE OFFICIAL AKC REGISTRATION PAPERS AS SOON AS JUDGMENT HAS BEEN MADE BY THE COURTS. SHOULD ANY CONFLICT ARISE BETWEEN THE PARTIES TO THIS AGREEMENT, THE PARTIES HERBY CONFESS AND AGREE THAT VENUE AND JURISDICTION SHALL BE IN THE COUNTY OF CATTARAUGUS, STATE OF NEW YORK.
