2. The PURCHASER is responsible for forwarding AKC litter registration application to register said dog within a reasonable period of time. Lucy Jakubowski {SELLER} retains breeding rights on all male puppies sold with a full registrations. Breeding rights to use said stud male are at no charge to Lucy Jakubowski. If said PURCHASER moves from address listed on contract, PURCHASER must notify SELLER within 10 days of new address and new phone number.
Breeding cannot be done till dog is over 1-1/2 years of age and with a passing Penn Hip or at 2 years of age with a passing OFA certificate. No male dog shall be bred to a female that has not passed her OFA. No male dog shall be bred to a white factored female or bred to a female with a "Z" in her AKC Registration number. All females bred to this male must have a negative Brucellosis test done 2 weeks before breeding. A male dog that is sold with a full registration with intentions of breeding cannot be bred till health tested and with a passing OFA certificate. OFA tests will be performed at Abbott Road Animal Hospital, 3816 Abbott Rd., Orchard Park, N.Y. 14127. 716-648-1340 or with other written choice and approved by SELLER. With males per contract, I have full breeding rights to the male with my bitches only. I do not request to have co-ownership with males.
3. A bitch when sold with full registration will be kept in SELLERS name and PURCHASER as a co-owner. The SELLER will sign off as co-owner when TWO AKC registered puppys are returned to SELLER from the first litter that is born from said bitch. The SELLER has first pick and third pick from that litter. No pups are to be transferred or sold by the PURCHASER before the pick is made. A first choice and third choice pick of two puppys resulting from said breeding will be chosen by SELLER. The puppys will be chosen by Lucy Jakubowski at 8 weeks of age. The puppys will be given to Lucy Jakubowski at 8 weeks of age with both AKC litter registration papers, tail docked, ears cropped, dew claws removed, up-to-date shots and worm free, at the expense of the PURCHASER. A two year health guarantee will be included with said puppys against all genetic defects, for hip dysplasia and all hereditary diseases. In the event of the birth of one puppy, the SELLER has the right to the ownership of that puppy. In the event of the death of first litter, SELLER has first and third pick from second litter. If the bitch is barren, the SELLER will replace the bitch with another puppy from the next available litter, at no extra charge. The cost of ear cropping will be charged. A bitch will be considered barren, at two uneventful breedings. A bitch that is sold with a full registration with intentions of breeding cannot be bred till the bitch reaches an age of 2 years old and health tested and with a passing OFA certificate. No bitch shall be bred to a male with no health testing, and a failing OFA. OFA tests will be performed at Abbott Road Animal Hospital, 3816 Abbott Rd., Orchard Park, N.Y. 14127. 716-648-1340 or with other written choice and approved by SELLER. No bitch shall be bred to a white factored male or bred to a male with a "Z" in his AKC Registration number.
4. The SELLER retains the right in the choice of the stud dog in the first breeding and the second breeding if the first is uneventful. The PURCHASER will be responsible for full amount of stud fee service, and all costs in producing the litter and all transportation costs in mating.
5. Prior to breeding said bitch, the bitch must pass OFA for hip dysplasia. A veterinary xray must be done at 2 years of age. If bitch fails her OFA, the bitch must be spayed and PURCHASER will be responsible for full amount of spaying.
6. No bitch shall be bred more than once a year, nor prior to 2 years of age, nor after 6 years of age and should be in good health and free from communicable diseases and disqualifying genetic faults. Therefore, it is also recommended that the breeders verify that the purchasers of puppies will be responsible owners who will provide proper homes and care.
7. No bitch or dog will be bred for commercial reasons. All bitches and dogs will be bred with the intention of that particular breeding in improving and bettering the breed. No puppies will be sold to pet stores or for medical experiments or sold to breeders with white factored Dobermans.
8. PURCHASER agrees that,if for any reason PURCHASER is unable to keep this Doberman dog/bitch, due to changes in circumstances, sickness, incompatibility or for any reason, this Doberman will be promptly returned to SELLER for attempted placement in a new home. PURCHASER MUST contact the SELLER/BREEDER. SELLER retains right to repurchase the animal. SELLER has the right of first refusal. Selling to a third party is only permissible after prior consultation with the SELLER, whereby the main consideration is the assurance that the dog is passed to responsible owners. A puppy that is returned that is 4 months old to 7 months old, the buy back amount for said puppy from PURCHASER will be $300.00, ONLY if said dog is found healthy within 14 days of surrender. A puppy that is returned that is 7 months or older, the buy back amount for said puppy from PURCHASER will be $200.00, ONLY if said dog is found healthy within 14 days of surrender. Within the 14 days that the said dog is returned or surrendered, any and all veterinary fees due to sickness that are incurred in that time frame will be the responsibility of the BUYER and must be paid to the SELLER in full to cover the veterinary bill. Each return of a animal has a different circumstance therefore, a refund check will be mailed 14 days after surrender OR when SELLER has placed animal in a new home, this is at the discretion of the SELLER. The buy back price for a puppy with ears not standing and no basic knowledge of commands and is wild is $100.00. After the age of 8 months the buy back price will be $100.00. The AKC registration papers will accompany said puppy at time of return. If we do not wish to buy the dog/bitch back from you we will give you our first refusal in writing at which time you are free to sell the dog to whomever you wish. Any one not offering us the first buy back on a puppy we have sold will be held accountable to breech fee of $1,000.00 (ONE THOUSAND DOLLARS). We do this as we do not wish to have our puppies end up in shelters or rescues.The buy back amount of $300.00, ONLY if said dog is found healthy within 14 days of surrender. Contract is null and void if the ears are cropped and not standing, the dog is found to have been mistreated, vaccinations schedule was not maintained and proof of all vaccinations must accompany any requests for replacement puppies or surrenders. No replacement will be given if the male or female has been bred, neutered, spayed or registration application form has expired. PURCHASER agrees that if SELLER finds dog unhealthy, crippled or with unsound temperament, 14 days from date said dog was returned, no moneys will be returned. It is further agreed that SELLER has complete and total control over placement of this Doberman. The cost of transportation of any pups to and from Braveheart Kennels and the cost of all veterinary services shall be the responsibility of the PURCHASER. SELLER never wants to see her dogs in a SPCA or RESCUE situation.
9. No bitch or male dog shall be bred to a white factored Doberman or a Doberman with a "Z" in their AKC Registration number. No bitch or male dog shall be bred to a Doberman that has not received his passing OFA.
By signing this agreement/contract, we affirm that we have read, understood and agree to abide to the terms of this contract to set forth for our benefit and the advancement and protection of this Doberman detailed herein. THIS FIVE (5) PAGE CONTRACT OF SALE HAS BEEN READ BY BOTH THE UNDERSIGNED BUYER AND SELLER AND THEIR SIGNATURES AFFIXED HEREUNDER SHALL ATTEST TO THEIR COMPLETE AGREEMENT AND UNDERSTANDING OF THE CONTENTS OFFERED HEREIN. THERE ARE NO VERBAL PROMISES OF COMMITMENTS OFFERED TO BUYER ON THIS DOG. ONLY BOTH PARTIES SHALL HONOR THOSE GUARANTEES LISTED HEREIN. THIS SHALL BE DEEMED A LEGAL AND BINDING CONTRACT AND THEREFORE FAILURE TO LIVE UP TO ITS TERMS CAN MEAN LEGAL RAMIFICATIONS, WITH THE PARTY AT FAULT BEING RESPONSIBLE FOR ANY LEGAL FEES INCURRED BY THE OPPOSING PARTY. IF BUYER IS FOUND TO BE IN VIOLATION OF THIS CONTRACT AND DOG IS LEGALLY REDEEMED BY SELLER, BUYER AGREES TO SIGN OVER TO SELLER THE OFFICIAL AKC REGISTRATION PAPERS AS SOON AS JUDGEMENT HAS BEEN MADE BY THE COURTS. SHOULD ANY CONFLICT ARISE BETWEEN THE PARTIES TO THIS AGREEMENT, THE PARTIES HERBY CONFESS AND AGREE THAT VENUE AND JURISDICTION SHALL BE IN THE COUNTY OF CATTARAUGUS, STATE OF NEW YORK.
